8.

What should I do if there is no sound to accompany a video?

Click the speaker icon in your menu bar to access your volume control settings. If the volume is adjusted to the lowest setting or to mute, you will not be able to hear the audio component of the video. You should, therefore, increase the volume setting.

9.

The video sometimes freezes or "skips," while the audio seems to work correctly. Is there something wrong with my computer?

No -- this is a symptom of heavy network traffic. The streaming video server will always attempt to deliver the audio at a constant rate, so that if traffic issues do occur, the video will skip frames, rather than disturb the flow of the audio.

10.

If I do not have the time to review an entire program, can I return to the program later and fast-forward to the spot where I left off?

Yes. Before exiting the program, take note of the elapsed time which shows at the bottom of the Windows Media Player screen.

When you return to the program, move the Seek Bar to the right until you get to the same elapsed time that you noted previously.

12.

What type of continuing legal education requirements are mandated by New York State's Mandatory Continuing Legal Education (MCLE) rules?

If you are a “newly admitted” attorney, you are required to complete 16 credit hours of accredited "transitional" education for each of your first two years of admission, broken down as follows: 3 hours of ethics, 6 hours of skills and 7 hours of practice management/professional practice. This requirement must be fulfilled each year by the anniversary date of your admission to the New York Bar. Attorneys are considered “newly admitted” for the first two years following admission to the New York Bar (except where they were engaged in the practice of law in another jurisdiction for the five years immediately preceding admission to the New York Bar). “Newly admitted” attorneys can only fulfill their MCLE credit requirements by attending “transitional” courses in a "traditional" format. “Transitional” courses consist of material that is appropriate for lawyers at the beginning stages of their career.  Courses with a "traditional" format refer to those given in a live classroom-style setting or, where approved by the New York CLE Board, fully interactive videoconferences.

If you are an “experienced” attorney (i.e., an attorney other than a "newly admitted" attorney), you are required to complete 24 credit hours of accredited education every two years, beginning immediately after the end of your "newly admitted" period. Of those 24 credit hours, you are required to complete 4 hours of ethics and 20 hours of other credits (i.e., these can include ethics, skills or practice management credits). These credits may be obtained by completing courses which have "non-transitional" content or content which is approved for both "transitional" and "non-transitional" purposes.  "Non-transitional" content is content that is more advanced and would not be appropriate for "newly admitted" attorneys.  In addition, "experienced" attorneys may obtain MCLE credit by completing courses with either a "non-traditional" format, such as programs posted on an internet site, like The Latham Network, or a "traditional" format (as described above). There are no restrictions on the number of credits that “experienced” attorneys may earn towards fulfillment of their MCLE credit requirements through the completion of “non-traditional” courses.

13.

As a newly admitted attorney, am I eligible to receive New York MCLE credit for viewing or listening to the programs posted on The Latham Network?

No.  As explained above, "newly admitted” attorneys are not eligible to receive MCLE credit for viewing or listening to the programs posted on The Latham Network because such programs are in a "non-traditional" format.  However, "newly admitted" attorneys based outside of the United States may fulfill a certain amount of their "transitional" education requirements by courses with a "non-traditional" format.  The current New York CLE rules should be consulted to gain a full understanding of this exception.

As an experienced attorney, am I eligible to receive New York MCLE credit for viewing or listening to the programs posted on The Latham Network?

Yes. To receive credit, make sure there are NY credits listed for the program you have chosen. After completing the program, you must print out and complete the corresponding MCLE Form, including writing your e-mail address and the verification code. Please send the completed MCLE Form to Karen Lombardo at the following address:

15.

What is a verification code (for NY MCLE only)?

The verification code is a six digit number that has been inserted into programs recorded after January 1, 2003 pursuant to the New York MCLE rules. The verification code will be flashed on the screen at some point during the program for a short period of time. To receive credit for viewing such programs, you must write the verification code on your MCLE Form. Programs recorded prior to January 1, 2003 do not have a verification code and thus there is no need to write anything on the verification code line provided on your MCLE Form.

16.

What type of continuing legal education requirements are mandated by California's Mandatory Continuing Legal Education (MCLE) rules?

Active members of the California State Bar must complete 25 hours of MCLE credit every three years. Of these 25 hours, 4 hours must be in the area of Legal Ethics, 1 hour in the area of the Prevention, Detection and Treatment of Substance Abuse/Mental Illness that Impairs Professional Competence and 1 hour in the area of Elimination of Bias in the Legal Profession.  However, certain Bar members, such as new admittees or newly active attorneys, may only be subject to a proportional MCLE requirement.  The California State Bar's rules should be consulted to determine whether you are subject to a proportional requirement, and if so, how to calculate it.  Your compliance deadline depends on the compliance group you have been assigned to.  Compliance groups and deadlines are posted on the California State Bar's website at www.calbar.ca.gov.

In addition, no more than half of the total 25 required hours (or half of your total proportional required hours) may be completed with self-study education activities, which are the types of activities provided on The Latham Network.
