Kenneth W. Weinstein retired from the partnership in October 2010. He was a partner in the Washington, D.C. office and a member of the firm's Litigation Department and Environment, Land & Resources Department.
Mr. Weinstein practiced for 25 years in the field of chemical regulation and pesticide law, serving as lead trial counsel in many groundbreaking cases. For example, he represented the American Crop Protection Association and other agriculture and industry groups in multi-forum federal district court and appellate litigation involving EPA's implementation of the Food Quality Protection Act. He was lead attorney in several precedential FIFRA data compensation arbitrations, EPA enforcement actions and a wide variety of other litigation matters covering the spectrum of regulatory issues. Mr. Weinstein argued before the US Supreme Court, and in numerous other federal trial and appellate courts.
In addition to litigation, Mr. Weinstein assisted many companies in facilitating regulatory approvals from EPA, and successfully defended many products against regulatory challenges. He has a degree in engineering and expertise in a variety of relevant scientific disciplines, including toxicology and ecotoxicology, endocrine disruption, biotechnology, endangered species, groundwater contamination and risk assessment. His representative clients, many of which he represented for more than two decades, included the American Crop Protection Association, Chemical Manufacturers Association, American Home Products, Aventis, BASF, Ciba Specialty Chemicals, Dow AgroSciences, FMC, Monsanto, Novartis, Rohm and Haas and Uniroyal.
Mr. Weinstein has co-authored two treatises on pesticide regulation and a treatise on toxic substances regulation, and has chaired the American Bar Association's Pesticide Law subcommittee. He was cited as a leading attorney in the environment category by Chambers USA legal guide.
