Environmental Project and Transactional Support
A significant portion of our Environment, Land & Resources Department's practice involves analyzing environmental issues in the context of Latham's global corporate, finance and real estate practices. We assist clients with assessing, managing and mitigating environmental liabilities and compliance obligations across our substantive environmental practice areas. We work directly with our transactional colleagues and clients to structure transactions in the manner most appropriate to the level of environmental risk encountered.
Latham & Watkins routinely counsels clients regarding environmental issues arising out of transactions, such as lender liability, the innocent landowner defense, successor liability, and the treatment of environmental liabilities under bankruptcy law. Our attorneys are experienced in drafting and negotiating critical environmental provisions of loan and purchase agreements, drafting environmental disclosure for public offerings, arranging for environmental insurance policies, and resolving indemnification disputes between buyers and sellers.
