PROFILE
Erin Brown Jones advises clients on enforcement, compliance, transactional, and litigation matters across a range of regulatory regimes, with a focus on the US Foreign Corrupt Practices Act (FCPA) and US securities laws and regulations. She serves as Co-Deputy Office Managing Partner of the Washington, D.C. office.
Erin was recognized in Global Investigations Review’s 2020 “40 Under 40” list recognizing the next generation of outstanding investigations specialists.
Erin represents clients in both domestic and cross-border investigations, and has experience navigating government-imposed compliance monitor decrees and regulator reporting requirements, advocating in front of government agencies, and engaging with cross-border teams, forensic accountants and experts, and external auditors, Boards, and other stakeholders. Erin has investigative experience with the Department of Justice (DOJ), Securities and Exchange Commission (SEC), Consumer Financial Protection Bureau (CFPB), Drug Enforcement Administration (DEA), Federal Bureau of Investigation (FBI), State Department, and Department of Commerce, as well as working with clients facing Congressional investigations. Her experience includes investigations around the world, including field work for major multinational companies in at least 16 countries across Asia, Europe, the Middle East, and the Americas. Complementing her government-facing work, Erin conducts internal investigations for clients across a range of compliance areas, including highly sensitive allegations of harassment, discrimination, hostile workplace, and retaliation.
In addition to her investigations practice, Erin also works closely with clients across industries – including the manufacturing, technology, pharmaceutical, aerospace, healthcare, and oil and gas industries – to review and enhance their internal compliance programs to align with US government expectations and industry leading practices, including drafting policies and procedures, conducting risk assessments, delivering proactive and insightful training, and advising companies with respect to innovative compliance monitoring and analytics. Erin also regularly advises clients in connection with cross-border M&A, financing, and capital markets transactions, including pre- and post-acquisition due diligence and counseling.
Prior to her experience at Latham, Erin held fellowships with the Department of Justice’s National Security Division and the Department of Defense’s (DOD) Office of Force Transformation, and also served in the AmeriCorps program.
Erin previously was a member of Latham’s Recruiting Committee, and currently serves on the firm’s Equal Employment Opportunity (EEO) Review Board and as a member of the ESG Task Force.
EXPERIENCE
Erin’s recent investigations experience includes:
- A major technology company to obtain a declination from DOJ and a reasonable SEC resolution in an investigation of high-profile alleged FCPA violations in India implicating members of senior management
- A global manufacturing company in conducting a virtual/remote investigation of potential pre-acquisition bribery by a recently acquired subsidiary in India
- Mylan N.V. in response to investigations by the House Oversight and Government Reform Committee and the Senate Judiciary Committee, among others, regarding the EpiPen Auto-Injector
- Several multinational life sciences companies in support of internal and government-facing anti-corruption investigations around the world, including field work in Indonesia, Saudi Arabia, Romania, India, China, and Macedonia
- Major healthcare company in a DOJ and SEC insider trading case, which was resolved without action against the company or company employees
- A global insurance firm in responding to anti-bribery and anti-money laundering investigations facing both the DOJ and UK Serious Fraud Office
- A lobbying and PR firm involved in a criminal investigation involving the Foreign Agents Registration Act
- A US-based financial institution in connection with a CFPB investigation related to consumer banking, which resulted in the matter being closed
- Multiple companies – including a major retailer and US healthcare facilities – in responding to investigations by the DEA, all of which resulted in reasonable resolutions
- An international non-profit organization in conducting an internal investigation into employee misappropriation in the Democratic Republic of Congo, ultimately collaborating with US prosecutors regarding the matter
- An energy company in an SEC investigation related to complex accounting and disclosure matters, resulting in no enforcement action
- A US-based manufacturer in obtaining declinations from DOJ and the SEC related to alleged FCPA violations in Poland
- Multiple aerospace and defense companies in conducting internal investigations and submitting voluntary disclosures to the Department of State’s Directorate of Defense Trade Controls, all of which were closed without action
Erin’s transactional and compliance work includes:
- A multinational manufacturing company in designing and conducting a comprehensive global anti-corruption risk assessment, including leading field work in Eastern Europe, the Middle East, Latin America, and Asia-Pacific
- A global technology company in building a world-class anti-corruption compliance program in the wake of a major government investigation
- A global food services company in designing and implementing a risk-based anti-corruption compliance program following an IPO
- A multinational pharmaceutical company in conducting a global post-acquisition anti-corruption risk assessment, including leading field work and forensic accounting analysis in Eastern Europe
- Several major companies – including a technology firm, logistics company, and oilfield services company – in providing real-time analysis and advice regarding third party compliance
- A Middle Eastern transportation company in developing practical compliance guidance regarding industry-specific corruption risks
- Multiple private equity firms in advising on anti-corruption risks with respect to acquisition and investment decisions
- A multinational agriculture company in conducting anti-corruption due diligence on several high-risk acquisition targets in Brazil
- Several non-profit organizations in designing, implementing, and executing risk-based anti-corruption compliance programs
- Designing and conducting virtual compliance risk assessments, including for companies in the biotechnology, oil and gas, and aerospace industries
