PROFILE
Marc Makary represents companies, government institutions, sovereign and private equity funds, and lenders in international project development and financing transactions and strategic joint ventures, primarily in the infrastructure, communications, power and water, and oil and gas industries. Marc has executed transactions in the Middle East, Europe, and the Americas, in addition to multiple developing markets around the globe.
Marc also specializes in network infrastructure projects. He is recognized as one of the world’s leading practitioners in the subsea fiber optic cable industry, having advised tech giants and developers on the development and operation of subsea cable systems from the Americas, to Europe, the Middle East, and Asia.
EXPERIENCE
Marc’s experience includes advising:
- Air Products, as the majority shareholder of a consortium, on the proposed acquisition from Saudi Aramco, and operation by the consortium for the benefit of Saudi Aramco, of US$12 billion in gasification assets located in Jazan Economic City
- The European Bank for Reconstruction and Development, the OPEC Fund for International Development, the African Development Bank, and Arab Bank on the financing package, also involving financing from the Green Climate Fund (GCF), to construct ACWA Power's Kom Ombo Solar Power Plant, the largest private solar plant in Egypt
- The sponsors on an estimated US$1.7 billion project financing of the Az-Zour North IWPP (approximately 1500 MW capacity) in Kuwait
- The owner in connection with a concession agreement, construction contract, and operation and maintenance contract for a seawater reverse osmosis plant in the Aramco-Dow Chemical Petrochemicals Complex in Jubail, Kingdom of Saudi Arabia
- An American technology conglomerate on developing two subsea cable systems connecting several landing points in Europe, the Middle East, Africa, and Asia
- The lead developer on the joint build and development of a submarine fiber optic cable system from the US to Denmark, with landings in Ireland and Norway
- The sponsors on developing, constructing, financing, and operating and maintaining a US$300 million terrestrial and subsea fiber optic cable system in Alaska
- The Public Investment Fund of Saudi Arabia on its US$507.2 million investment in Jio Digital Fiber, Reliance Industries’ fiber optic asset subsidiary, and its US$1.5 billion acquisition of a minority stake in Jio Platforms, Reliance Industries’ digital services subsidiary
- Global Infrastructure Partners on financing its US$3.4 billion acquisition of a controlling interest in EnLink Midstream, the owner and operator of gas processing, transportation, storage, and fractionation assets, involving US$1 billion secured term loan facilities
- The purchasers, as project finance counsel, on the US$5.6 billion proposed acquisition of Calpine Corporation, the largest generator of electricity from natural gas and geothermal resources in the US, including in connection with related financing arrangements
