PROFILE
Brittany Record is an associate in the Washington, D.C. office of Latham & Watkins.
Brittany focuses on case strategy and motions practice in complex cases in state and federal courts. She has argued several cases in the Fourth and Seventh Circuits, the Virginia Supreme Court, and the Virginia trial courts.
She previously served as Deputy Solicitor General of Virginia.
Before joining Latham, Brittany served as a law clerk to Justices Ruth Bader Ginsburg and Stephen G. Breyer of the Supreme Court of the United States, Judge Patricia Millett of the US Court of Appeals for the Washington, D.C. Circuit, and Judge Jeffrey Sutton of the US Court of Appeals for the Sixth Circuit.
Brittany earned her JD from Stanford Law School, where she served as President of the Stanford Law Review.
EXPERIENCE
Brittany’s experience includes:
- Successfully moving to dismiss a large class action alleging securities fraud against a major producer of plant-based meat products and its executives in the Central District of California
- Successfully defending a constitutional ruling piercing a statutory collateral review bar in favor of two pro bono clients in the Virginia Court of Appeals
- Successfully moving to dismiss a large class action alleging securities fraud against a major aerospace company and several executives in the Eastern District of New York, and successfully defending that victory from interlocutory appeal
- Successfully securing review from the Michigan Supreme Court on an issue of nationwide importance to the client’s business model and the sharing economy
- Successfully representing several health systems in defending the dismissal of a lawsuit seeking over a billion dollars in damages in the Fifth Circuit Court of Appeals
- Representing multiple clients in ongoing, high-profile securities litigation related to the collapse of the FTX trading platform in a multi-district litigation
- Preparing high-level executive for public testimony in a live congressional hearing
- Successfully representing the Commonwealth of Virginia in numerous high-profile appeals and trial matters, including election-related constitutional litigation and the defense of several high-profile Virginia statutes and executive actions*
- Advising members of Congress on complex and novel legal issues arising out of challenges to congressional subpoenas, including issues of separation of powers and executive privilege*
- Advising state agencies and the Virginia legislative and executive branches on the constitutionality of state programs, policies, and draft legislation*
