Anne Malinee litigates high-stakes business disputes in federal, state, and arbitral venues across the United States.
Anne leverages her extensive trial experience on behalf of individuals, private equity firms, and public companies engaged in “bet-the-company” litigation. She represents both plaintiffs and defendants in matters involving:
- Breach of contract
- Copyright infringement
- Unfair competition
- Trademark infringement
- Fraud
- Misappropriation of trade secrets
- Violation of restrictive covenants
- Equitable claims
Anne develops and executes litigation strategy across multiple forums simultaneously, including with international components, to achieve her clients’ objectives.
Before entering private practice, Anne served as a law clerk to Judge Julia Smith Gibbons, US Court of Appeals for the Sixth Circuit.
Anne earned her JD from the University of Virginia School of Law, where she was the winner of the William Minor Lile Moot Court Competition and an editor on the Journal of Law & Politics.
EXPERIENCE
Anne’s experience includes:
- Representation of CoStar Group, an international commercial real estate data firm, including:
- In federal court litigation in Los Angeles against Commercial Real Estate Exchange, Inc. (CREXi), a major CoStar competitor valued at half a billion dollars in 2022 and backed by multiple venture capital funds, involving claims for copyright infringement and violations of the Digital Millenium Copyright Act
- In federal court litigation in Washington, D.C. in which CoStar obtained a permanent injunction against CREXi’s founding investor for hacking into CoStar’s database
- Coordinating a team that obtained multiple judgments and injunctions in foreign courts against CREXi’s offshore agents for facilitating copyright infringement
- Trial counsel for global private equity firm The Carlyle Group, one of its investment funds, and individual fund executives in AAA arbitration and state-court litigation brought by a municipality seeking more than US$600 million. After more than six years of litigation, a two-week arbitration hearing resulted in a complete defense victory. The American Lawyer recognized Anne and her colleagues as litigator-of-the-week runners-up*
- Trial counsel for a global defense contractor in multiple commercial arbitrations before AAA panels, with alleged damages ranging from US$18 million to more than US$1 billion*
- Trial counsel for two bankers in a FINRA arbitration involving allegations of trade secret misappropriation and violation of restrictive covenants*
- Representation of Synergy Marine investor in the Francis Scott Key Bridge allision response and investigations
- Representation of British Petroleum in multi-district litigation proceedings arising out of the Deepwater Horizon oil spill*
- Representation of a publicly traded company in federal court defending a claim that its newly adopted corporate name infringes the trademark rights of another party*
- Representation of the president of a reinsurance company in DOJ and SEC investigations and related civil litigations*
- Pro bono trial counsel for a defendant in a jury trial in Maryland state court involving felony theft charges, winning a motion for judgment of acquittal*
