Latham’s Congressional Investigations practice helps clients navigate the unique political, legal, communications, and reputational considerations involved when engaging with Congress.
Our bipartisan practice is co-led by two former Deputy White House Counsels who were responsible for Congressional oversight across the Executive Branch in different administrations. The practice also includes former senior staff of key Congressional committees, federal prosecutors, and senior White House and Executive Branch officials in Republican and Democratic administrations. Many members of the practice have extensive experience conducting investigations as Congressional staff and representing clients facing Congressional investigations.
Our team represents companies, boards, and individuals at all stages of Congressional investigations. We have been engaged at the outset of an investigation to assess the facts and craft a strategic response. We are also routinely retained by clients when their initial engagement with Congress has broken down, to reset the working relationship and reestablish credibility. We prepare clients to testify privately and publicly before Congress in high-profile matters, and we work closely with communications and government affairs professionals as warranted by the circumstances.
Congressional investigations are rarely isolated events; they often precede or follow regulatory or enforcement actions, as well as civil litigation. We routinely advise clients through such interrelated proceedings, engaging in reputation management, and maintaining credibility with Congress and other relevant investigating entities, while helping clients avoid the distractions that often come with controversy matters.
