The current tables indicate that all Member States are comply or intend to comply with ESMA Guidelines, with the exception of certain jurisdictions for which compliance is not yet possible pending designation of the MiCA competent authority or where no response has been received.

The transition period under the EBA’s June 2025 No Action letter (NAL) on the interplay between PSD2 and MiCA comes to an end on 2 March 2026. Since the NAL was published, a large number of CASPs have approached national competent authorities (NCAs) informally or submitted authorisation applications. On 12 February 2026, the EBA published an Opinion on supervisory priorities to guide NCAs on how to prioritise their authorisation efforts as the NAL transition period expires. The Opinion also highlights that the execution of electronic money token (EMT) transfers (including first-party transfers between wallets held by the same user) may constitute payment transactions under PSD2, regardless of whether the custodial wallet qualifies as a payment account.

On 28 January 2026, ESMA published its Guidelines for assessing the knowledge and competence of staff at cryptoasset service providers (CASPs) who give information or advice to clients about cryptoassets or cryptoasset services under MiCA. The Guidelines distinguish between staff who merely give information and those who provide advice, with the latter being held to a higher standard of knowledge and competence. They prescribe minimum qualification and experience requirements for each category, amongst other requirements.

On 28 November 2025, ESMA published a statement with practical guidance to support the implementation of the MiCA data standards and format requirements that apply to CASPs, issuers, offerors, and persons seeking admission to trading. It covers the technical specifications for five key areas: (1) the format of order book records for CASPs operating trading platforms; (2) the data standards for record-keeping by all CASPs; (3) the manner in which trading platform CASPs must present transparency data; (4) the format and data standards for MiCA white papers; and (5) the data necessary for the classification of cryptoasset white papers.
