Adrien Giraud is a partner in Latham & Watkins’ Paris office and a member of the firm’s Global Antitrust & Competition Practice. He specializes in French and European competition law and has significant experience in merger control, behavioral antitrust matters (including damages claims), and State aid.

Adrien has 20+ years of experience advising French and international clients in complex EU and French merger cases and in some of the most significant antitrust investigations of recent years. His experience also encompasses civil antitrust damages litigation, an area in which he has represented clients in proceedings before the French courts. Furthermore, Adrien advises companies and public authorities on state aid compliance and assists them with European Commission state aid investigations and related litigation before the European courts.

Adrien is a member of the board of directors and general secretary of the Association des avocats pratiquant le droit de la concurrence. (APDC). He is also founder and president of l’Entente, a Brussels-based association of French-speaking antitrust professionals. A recognized thought leader, Adrien frequently contributes to publications on EU and French competition law (“EU Competition Law and Pharmaceuticals” book, part of the New Horizons in Competition Law and Economics series, Edward Elgar editions, 2022; Lamy Droit Economique, Article 102 Chapter, Wolters Kluwer, 2019).

  • Essilor in obtaining unconditional Phase II EC approval for its acquisition of Luxottica*

Antitrust Investigations and Litigation

  • Ingram Micro in its successful appeal relating to a decision of the French Competition Authority
  • French newspaper editors association (APIG) in their successful complaint against Google before the French Competition Authority
  • Orange before the Paris Court of Appeals and the Commercial Chamber of the French Court of Cassation in various damage claims
  • CMA CGM in an EC investigation with respect to alleged anticompetitive practices on trades to/from Europe*

State Aid

  • CCR in successfully defending the compatibility decision of the unlimited State guarantee against SCOR (T-135/17)
  • CCR on a litigation before the French administrative courts relating to the guarantee granted to CCR by the French state for the reinsurance of disaster risks
  • France Télévisions in four consecutive court victories against privately-owned French broadcasters seeking to challenge subsidies granted to France Télévisions by the French State*
  • Crédit Mutuel in European Court proceedings to obtain the annulment of a Commission decision ordering the reimbursement of more than €160 million of alleged state aid*
